TERMS AND CONDITIONS

By accessing Autodata Training and any of its online training modules including without limitation any component of videos, guided instruction, tutorial, quizzes, course materials, or other materials, you agree to be bound by these terms including without limitation the content licence herein contained. Nothing contained in these terms or otherwise shall be deemed to constitute a representation, guarantee, or promise that a particular result will be produced due to any Autodata Training online training or use of any Autodata Training website content.

You agree that this agreement is enforceable like any written agreement negotiated and signed by you. Autodata Training reserves the right to change terms of use posted on the Autodata Training website or contained within the learning system from time to time at its sole discretion.

Your continued use of the site or any content accessible through it, after such notice has been posted constitutes your acceptance of the changes. Your use of the Autodata Training website is subject to the most current version of the Autodata Training terms on the site at the time of such use. If you breach any of the Autodata Training terms and conditions, your authorisation to use this site and its content may be automatically terminated.

Access to or use of Autodata Training website constitutes your agreement with the current Autodata Training terms and conditions.

Autodata Training is offered exclusively at https://www.autodata-training.com or via its licensed partners.

Clients may access the site or licensed partner sites directly or be referred or redirected to the site by one of our partners or distributors (other web sites or direct referrals). Clients will register for the training and access the training through our secure gateway. Various payment options exist and more information can be obtained by contacting Autodata Training (support@autodata-training.com).

Once payment has been verified, clients will have access to the learning content for the period stipulated in their chosen payment option. Subscription payments will occur on an ongoing basis as stated during the purchasing process. We may change the price of our subscription from time to time. An active subscription is required for continued access to the Autodata Training portal.

Users are solely responsible for ensuring that they have sufficient and compatible hardware, software, telecommunications equipment and Internet service necessary for use of the Site.

 

CANCELLATION AND REFUNDS

We require written notice for all cancellations. Please contact us via email at support@autodata-training.com. We will confirm your request, your billing will be terminated within the current billing period and your account will be deactivated at the end of the current billing period. 

Any requests for refund must be directed via email to support@autodata-training.com. Any refunds will be at the discretion of Autodata Training.

Upon account deactivation, access to the Autodata Training Learning content and all associated material shall cease.

 

OWNERSHIP AND PROPRIETARY RIGHTS;


LICENSE:

The Autodata Training website and Autodata Training portal content including, without limitation, its component videos, guided instruction, tutorials, and handout materials as well as all other documentation, materials, files and presentation slides (and their selection and arrangement) is the property of Autodata Training or its licensors and is protected by copyright and other intellectual property laws and also may be protected by components that protect digital information. The Autodata Training portal content may be viewed for your personal, informational, and non-commercial use only. You may not modify, copy, download, publish, transmit (including but not limited to, by way of email, facsimile, or other electronic means), frame, sublicense, assign, display, participate in the transfer or sale of, rent, lease, loan, create derivative works based on, or in any other way exploit any of the Autodata Training portal content.

Any permitted downloads or copies of the Autodata Training portal content must retain the copyrighted notice and any other proprietary notices contained in such materials. You may not use any of the materials contained in the Autodata Training portal in any manner that may give a false or misleading impression or statement as to Autodata Training or any third party referenced in the Autodata Training portal content.

You further acknowledge and agree that all copyrights, patents, trade secrets, concepts, techniques or other intellectual property rights associated with any ideas, concepts, creations, designs, engineering details, techniques, inventions, processes, works of authorship, course materials, documentation, and Autodata Training portal content developed, created, or used by Autodata Training or its personnel in connection with the Autodata Training portal content are and shall remain the sole and exclusive property of Autodata Training and/or its Licensor and are proprietary information of those parties.

Autodata Training reserves all rights not expressly granted to you. Except as otherwise provided by law, you may not reverse engineer, disassemble, decompile, or translate the Autodata Training portal content, or otherwise attempt to derive the source code of any Autodata Training portal content or other software which may be related to the Autodata Training website, portal or content. No right, title, or interest in or to any trademarks, service marks, or trade names of Autodata Training or its licensors is granted hereunder and any use thereof will ensure solely to the benefit of Autodata Training and/or Autodata Training’s licensors. Nothing herein shall be construed as conferring any license under Autodata Training’s intellectual property rights, whether by estoppel, implication or otherwise.

All software and content, including without limitation Autodata Training software, required by you in connection with the use of the Autodata Training website and portal is licensed pursuant to the terms and conditions set forth in the software license agreement accompanying such software and such terms and conditions are in addition to these Autodata Training terms.

 

PROHIBITED CONDUCT:

User expressly agrees to refrain from doing, either personally or through an agent, any of the following “Prohibited Conduct”:

  • Transmit, install, upload or otherwise transfer any virus, advertisement, communication, or other item or process to the Site that in any way affects the use, enjoyment or service of the Site, or adversely affects Autodata Training’s or its providers, servers or databases.
  • Capture, download, save, upload, print or otherwise retain information and content available on the Site other than what is expressly allowed by these Terms.
  • Permit or provide others access to the Autodata Training portal or its content using your user name and password or otherwise, or the name and password of another authorised User.
  • Copy, modify, reverse engineer, disassemble, redistribute, republish, alter, create derivative works from, assign, license, transfer or adapt any of the software, information, text, graphics, source code or HTML code, or other content available on the Site.
  • Remove or modify any copyright, trademark, legal notices, or other proprietary notations from the content available on the Site.
  • Transfer the Site content to another person; “frame,” “mirror,” “in-line link,” or employ similar navigational technology to the Site content.
  • Violate or attempt to violate Autodata Training or its provider’s security mechanisms, Access any data or server you are not authorized to Access or otherwise breach the security of the Site or corrupt the Site in any way.
  • Engage in any other conduct which violates the Copyright Act or other laws of Australia, the United States, the European Union or any other country from which the Autodata Training content is accessible.
  • Use the Site to violate a third party’s intellectual property, personality, publicity or confidentiality rights; upload, download, display, publish, perform, create derivative works from, transmit, or otherwise distribute information or content in violation of a third party’s intellectual property rights.
  • Misrepresent Your identity or personal information when Accessing the Site; forge any TCP/IP packet header or any part of the header information in any email so that the email appears to be generated by Autodata Training.
  • Advertise or otherwise solicit funds, goods or services on the Site.
  • Provide any commercial hosting service with Access to the Site and/or the content on the Site.

To ensure that Users of the Site do not engage in Prohibited Conduct, Autodata Training reserves the right to monitor use of the Site and to revoke or deny Access to Autodata Training’s website, training portal or any other site which contains data or information upon which Autodata Training holds access rights or copyright ownership to any person or entity whose use of the Autodata Training site or portal suggests Prohibited Conduct. Access of the materials available at the Autodata Training website and portal beyond that of normal patterns of use that suggests systematic copying of the materials constitutes abuse of the Autodata Training terms and will result in revocation or denial of Access to the Autodata Training website or portal. The terms “normal patterns” and “abuse” shall be determined solely by Autodata Training.

You agree not to violate any Australian, European Union, United States of America, foreign or international software or technology export laws and regulations.

 

LIABILITY LIMITATIONS:

You agree that Autodata Training’s entire liability, and your only recourse, with respect to any services provided under this Agreement, or to any breach of this Agreement is solely limited to the amount you paid for such services. Autodata Training, our contractors and providers shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of our services, or for the cost of arranging substitute services. We disclaim any and all loss or liability resulting from, the following: (1) delays or interruptions in access; (2) faulty delivery or non-delivery of data; (3) acts of God; (4) errors, omissions, or misstatements in any information or services provided under this Agreement; THE LIMITATIONS OF OUR LIABILITY ARE BY NO MEANS LIMITED TO THE FOREGOING CONDITIONS. You also agree that we will not be liable for any interruption of business, or any indirect, special, incidental, or consequential damages of any kind (including lost profits), regardless of the form of action. This applies to damages in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility of such damages. In no event shall our maximum liability exceed the amount paid for services.

 

SEVERABILITY:

You agree that the terms of this agreement are severable. If any term or provision is declared invalid or unenforceable, that term or provision will be construed consistent with applicable law, to reflect as closely as possible the original intentions of the parties, and the remaining terms and conditions will remain in full force and effect.

 

NON-WAIVER:

If we, at any time, do not require performance by you of any provision in this agreement, it will have no effect whatsoever on our full right to require such performance at any time thereafter. Further, the waiver, by us, of any breach of any provision of this agreement should not be considered a waiver of the provision itself.

 

ENTIRETY:

You agree that this Agreement, and the rules and policies published by us, are the complete and exclusive agreement between you and Autodata Training, regarding our services. This Agreement overrides any previous agreements or understandings. This is true regardless of whether those understandings take the form of established custom, policy, practice, or precedent.

 

GOVERNING LAW:

This Agreement is governed by the laws of Australia, the United States, the European Union and any other country from which the Autodata Training content is accessible.

 

ACCEPTANCE OF AGREEMENT:

By continuing to the Autodata Training portal you acknowledge that you have read this Agreement, and that you accept all of its terms and conditions. You also are not relying on any representation, guarantee, or statement, other than the ones set forth in this Agreement. By using our services you automatically accept the terms of this Agreement.
